My neighbor and I share a fence (55' section) that divides our property. The fence is 30 years old and has been spot-repaired for years. Several sections of the fence have collapsed due to storms this past winter. We live in the Kingsgate subdivision of Kirkland WA. I've contact 3 fence contractors to assess the fence to provide estimates to repair/replace the fence. The assesment from all 3 contractors is that the fence has surpassed it's life expectancy and is beyond repair. They've also recomended the fence be replaced. The hitch here is my neighbor is a renter. I've contacted the absentee landlord regarding replacing the fence. I've provided the 3 bids and have request the landlord share 50% of the cost (total $1800, $900 per household) The landlord has committed to paying $500, but refuses to accept 50% responsibility. Can you provide any input regarding Washington law that covers responsibilities for shared fencing the bisects 2 properties? Is small claims court an option? Thanks in advance, Matt... Read More »
